StenoCast Support Service Agreement, Returns Policy & Accidental Damage No-Fault Warranty Terms & Conditions
Every StenoCast product comes with a 15-day, no-questions-asked return policy. Customers who purchase StenoCast products (as distinguished from Subscribers) may return their StenoCast product to StenoCast, Inc. within 15 days of purchase for a full refund, less a 15% restocking fee & shipping, provided the product is in a like-new, sellable condition.
Subscribers may return their StenoCast products at any time within the 12-month subscription period and are responsible only for the four quarterly payments during that 12-month period.
StenoCast, Inc. shall also provide technical support for all StenoCast products free of charge for 30 days from the date of purchase of said StenoCast product. Customers may call StenoCast, Inc. for technical support at 858.578.4600 extension 2. Customers may email support questions free of charge to StenoCast, Inc. at support@stenocast.com for as long as they own their StenoCast product.
StenoCast, Inc. warrants all StenoCast products against defects in materials and workmanship for one year from date of purchase. This warranty is not transferable. If StenoCast, Inc. receives notice from a customer of a defective StenoCast product, StenoCast, Inc. will, at its option, repair or replace the part or parts that are deemed by StenoCast, Inc. to be defective. StenoCast, Inc.'s liability shall be limited, at StenoCast, Inc.'s option, to repair or replacement of the defective parts or the entire unit. SUBJECT TO LOCAL LAW, THE ABOVE WARRANTIES ARE EXCLUSIVE AND NO OTHER WARRANTY, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, HTC SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.
Customer may also purchase an Accidental Damage No-Fault Warranty from StenoCast, Inc. for their StenoCast product. This is a no-fault, no-explanation-needed warranty on the covered item. If the covered StenoCast product fails to perform for ANY ACCIDENTAL REASON, whether dropped, stepped on, chewed on by the dog, power surge, or just doesn't work (you get the point), StenoCast, Inc. will replace said product. Customer pays for actual shipping costs only. StenoCast, Inc. pays shipping charges for Subscription customers. Upon receipt by StenoCast, Inc. of a product covered by the Accidental Damage Warranty we will send a replacement product within 24 hours, excluding weekends and holidays.
Limitations of Liability and Remedies: Except to the extent that the following limitation of liability and remedies is prohibited or limited by local law, the following limitation of liability and remedie4s applies. For any material breach of this Agreement by StenoCast, Inc., Customer's remedy and StenoCast, Inc.'s liability will be limited to a refund of the price paid for this Agreement for the products at issue. StenoCast, Inc. will not be liable for performance delays or for nonperformance due to causes beyond its reasonable control. SUBJECT TO LOCAL LAW, THE REMEDIES PROVIDED IN THIS AGREEMENT ARE CUSTOMER'S SOLE AND EXCLUSIVE REMEDIES. EXCEPT AS INDICATED ABOVE, IN NO EVENT WILL STENOCAST, INC., ITS AFFILIATES, ITS SUBCONTRACTORS, RESELLERS OR SUPPLIERS BE LIABLE FOR LOSS OF DATA OR FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING DOWNTIME COSTS OR LOST PROFIT), OR OTHER DAMAGE WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE..
Limitations of Service: Unless otherwise specified, warranties and services do not cover any damage or failure caused by (1) site conditions that do not conform to StenoCast, Inc.'s site specifications; (2) neglect, improper use, fire or water damage, electrical disturbances, work or modifications to the device; performance or non-performance of third-party vendors, their products or devices, or their support services.
Customer Responsibilities: Customer is responsible to purchase the Accidental Damage Warranty and Service Contract within 15 days of the purchase of their StenoCast device. STENOCAST, INC. IS NOT OBLIGATED TO PROVIDE SUPPORT SERVICES IF CUSTOMER DOES NOT PURCHASE THE EXTENDED WARRANTY AND SERVICE CONTRACT. Customer is responsible for performing the following functions prior to return shipping a failed hardware product to StenoCast, Inc.: (a) perform all technical support trouble-shooting procedures specified by the product manual and/or technical support personnel; (b) provide StenoCast, Inc. the product serial number and ship-to address (if applicable); (c) packaging the failed product carefully in the original or StenoCast, Inc.-provided shipping container or a shipping container that prevents the product from being damaged while in transit to StenoCast, Inc..
Term: For Accidental Damage Warranties and Service Contracts, the terms of this Agreement will begin on the date of the initial purchase of the Accidental Damage Warranty and Service Contract and will terminate at the end of the specified number or years of service purchased.
Termination: Customer may terminate the Agreement by notifying StenoCast, Inc. within 15 days of purchase to receive a full refund. StenoCast, Inc. may terminate this Agreement at any time after the effective date of this Agreement if Customer fails to perform or observe any conditions of this Agreement with StenoCast, Inc.
Governing Laws: Any disputes arising in connection with the Agreement will be governed by the laws of the State of California , U.S. The courts of San Diego , California shall have jurisdiction.
Entire Agreement: The terms and conditions of the Agreement constitute the entire understanding between the parties relating to the provision of services described herein and will supersede any previous communication, representation or agreement whether oral or written. Customer's additional or different terms and conditions will not apply. Customer's acceptance of this Agreement is deemed to occur upon Customer's purchase of service, or failure to give notice of termination to StenoCast, Inc. within 15 days or StenoCast, Inc.'s provision of any support services. No change of any of the terms and conditions will be valid unless in writing, signed by an authorized representative of each party. |
